Platform Terms of Use — Furnished Finder Canada

1) Application of these Terms

These Platform Terms of Use (the “Terms”) apply to the Furnished Finder Canada websites and any related mobile or desktop applications (collectively, the “Platform”) and any services, features, content, and tools offered through the Platform (the “Services”).

The Platform is operated in Canada by Coastal Group Management Consulting LP doing business as Furnished Finder Canada (“FFC”, “we”, “us”, “our”). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Important legal note: these Terms include an individual dispute requirement and a class action waiver to the extent permitted by applicable law (see Section 11).

2) Privacy

Our Privacy Policy explains how we handle personal information. It is separate from these Terms, but it applies to your use of the Platform. Privacy email: privacy@furnished-finder.ca.

3) Accessing the Platform; accounts and security

• We may change, suspend, or discontinue parts of the Platform at any time.
• You are responsible for arrangements needed to access the Platform and ensuring anyone using your device/connection follows these Terms.
• If you create an account, you must provide accurate, current, and complete information.
• Keep your login credentials confidential. You are responsible for activity under your account except where prohibited by law.
• Notify us promptly of suspected unauthorized access and log out at the end of each session.
• We may disable accounts, usernames, or access for any reason, including suspected violations or security risks.

4) Marketplace role; not a party to rentals

The Platform helps property owners/managers (“Property Owners”) advertise properties to prospective renters/travelers (“Renters”). FFC does not own or manage listed properties and is not a party to rental agreements or disputes between Users.

5) Reviews

Reviews help Users make informed decisions. You must not manipulate reviews or post content that is defamatory, harassing, hateful, obscene, or that discloses personal information of others. We may remove or refuse reviews at our discretion.

6) Intellectual property; permitted use

The Platform and its content (“Materials”) are owned by FFC or licensors and protected by applicable intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial use as intended.

You may not scrape, harvest, commercially exploit, reverse engineer, or misuse Platform content or user information.

7) Electronic communications and SMS

You consent to receive electronic notices from us related to the Platform and Services. If you opt in to SMS/text messages, you may receive service-related messages.

8) Acceptable use; prohibited conduct

You agree that you will:

• Use the Platform only for its intended purposes and in compliance with applicable laws.
• Be at least 18 years old.

You agree you will not:

• Violate laws or third-party rights (including IP and privacy rights).
• Impersonate others, harass users, or post obscene/violent/hateful content.
• Upload malware, attempt unauthorized access, or disrupt Platform operation.
• Send spam or unsolicited commercial messages to Users.
• Scrape or commercially exploit listings, user data, or contact information.

We may investigate, remove content, restrict features, suspend accounts, or terminate access to protect the Platform and Users.

9) Disclaimer of warranties

To the fullest extent permitted by applicable law, the Platform and Services are provided “as is” and “as available” without warranties or conditions of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted or error-free operation, or the accuracy of listings or user content.

10) Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, aggravated, or punitive damages, or loss of profits, revenue, data, goodwill, or business opportunities.

Except where prohibited, our total liability for all claims relating to the Platform or these Terms will not exceed the fees you paid to us in the 12 months before the event giving rise to the claim.

11) Individual dispute resolution; class action waiver

To the extent permitted by applicable law, disputes will be brought only on an individual basis and not as part of any class, collective, or representative action. You waive participation in class proceedings to the extent permitted.

Nothing in this section limits your right to bring a matter in a forum that cannot legally be waived or excluded.

12) Governing law and venue

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Unless a different venue is required by applicable law, you agree that proceedings relating to these Terms will be brought in the courts located in Vancouver, British Columbia.
