About these Listing Terms
These Property Listing Terms and Conditions (the “Listing Terms”) govern the relationship between the Property Owner identified in the applicable subscription, listing order, sales order, or services agreement referencing these Listing Terms (the “Listing Agreement”) and Coastal Group Management Consulting LP doing business as Furnished Finder Canada (“FFC”, “we”, “us”, “our”) related to listing short-term or furnished rental properties (each, a “Property”) on the Platform.
These Listing Terms + the Listing Agreement together form the “Agreement”. Capitalized terms not defined here have the meanings given in the Platform Terms of Use. By creating or maintaining a listing, you agree to this Agreement.
1) Services
1.1 Listing and advertising services
Subject to payment of applicable fees and any verification requirements, we grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform solely to advertise your Property to prospective renters/travelers (“Renters”) and to use Platform listing tools as intended.
1.2 Verification
We may verify your identity, contact details, and authority to list a Property. You authorize us and our service providers to conduct reasonable verification checks and you agree to provide requested information promptly. If verification cannot be completed to our satisfaction, we may decline, suspend, remove listings, or terminate access. Fees are non-refundable except where required by law or expressly stated in a Listing Agreement.
1.3 Not a party to rentals
We are not a party to rental agreements or payments between you and Renters unless explicitly stated in writing as part of a specific feature. You control rental terms, screening, pricing, and payment methods (subject to Platform rules).
1.4 Renter screening
You are responsible for your communications with Renters and any screening you choose to perform. We do not guarantee identity, background, or suitability of Renters.
1.5 Ratings and professionalism
Renters may rate/review you and/or your Property. You agree to maintain professional conduct, respect, safety, and any minimum quality thresholds we may apply.
1.6 Third-party distribution
We may distribute listing information to third-party channels to broaden exposure. Additional third-party terms may apply.
1.7 Notifications and SMS
We may send notifications (including SMS/text where you opt in) about leads, inquiries, messages, booking requests, and reminders. Opt out by replying STOP. Help: reply HELP or contact [SUPPORT EMAIL PLACEHOLDER] / [SUPPORT PHONE PLACEHOLDER]. Message frequency may vary. Message/data rates may apply.
2) Property Owner obligations and responsibilities
2.1 Compliance with law
You are solely responsible for complying with all applicable laws and requirements related to your Property and rental business, including federal, provincial/territorial, and municipal laws/bylaws, licensing, permits, taxes, safety, building rules, strata/condo rules, human rights and non-discrimination rules, and privacy obligations.
2.2 Listing accuracy and maintenance
You are responsible for listing content and keeping it accurate and current, including amenities, location descriptors, pricing, and availability. We may suspend/remove listings that are misleading, incomplete, or not maintained (for example, prolonged failure to update availability).
2.3 Licence to listing content
You grant us and our affiliates a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, translate, format, display, distribute, and otherwise use your listing content as needed to operate and promote the Platform (including third-party distribution). After your subscription ends, we stop displaying the listing as active within a reasonable time, but may retain copies for backups, legal compliance, dispute resolution, fraud prevention, and recordkeeping.
2.4 Renter personal information; privacy and anti-spam
If you obtain a Renter’s personal information through the Platform, you may use it only for Platform-related communications, facilitating a rental transaction, and providing service related to that rental. Marketing requires valid consent and must comply with applicable privacy and Canadian anti-spam requirements. You must safeguard personal information and not disclose it to third parties without consent unless permitted/required by law.
2.5 Translations and maps
If your content is translated for display, translation quality is not guaranteed. Third-party maps/tools are subject to their terms.
2.6 Insurance
We do not provide insurance for Property Owners or Properties. You are responsible for obtaining and maintaining adequate insurance coverage for your rental activity.
3) Fees and payment terms
3.1 Fees
Fees are as set out in your Listing Agreement or the checkout flow applicable to your listing.
3.2 Automatic renewal
Subscriptions may renew automatically at the end of the term at the then-current non-promotional rate unless you turn off auto-renew in your account before renewal.
3.3 Subscription term
Subscription terms and start/end dates are described in your Listing Agreement or checkout flow.
3.4 Refunds
Except where required by law or expressly stated in the Listing Agreement, fees are non-refundable, including where verification cannot be completed or if you stop renting/sell the Property.
3.5 Taxes
Fees are exclusive of applicable taxes. You are responsible for taxes and similar charges, other than taxes based on our income.
4) Additional listing rules
4.1 Search placement
We do not guarantee any particular search placement or visibility. Ranking may vary by search criteria, subscription tier, listing quality, calendar freshness, responsiveness, and marketplace testing.
4.2 Content review
We may refuse, remove, or request changes to content that violates this Agreement or Platform standards. You are responsible for reviewing and ensuring listing accuracy.
4.3 Photos
Photos must comply with content standards and accurately depict the Property. Do not upload images of people without appropriate permission/consent. By uploading photos, you represent you have the rights to use them and they are not misleading.
4.4 Branding
You may not use our trademarks/logos in advertising without written permission, or imply endorsement. You may describe that you list on the Platform and share listing URLs.
4.5 One listing per Property; substitutions
Each listing must be for a single, uniquely identified Property unless your package expressly allows otherwise. Substituting a different Property requires approval (or an in-product mechanism we provide).
4.6 Safe payment methods
You may not require Renters to pay via cash-by-mail or instant cash-wire services for bookings initiated through the Platform. We may remove listings for unsafe payment demands or fraud indicators.
4.7 Feedback
If you provide feedback about the Platform, you agree we may use it without restriction or compensation to the extent permitted by law.
5) Relationship of the parties
The parties are independent contractors. Nothing creates a partnership, agency, employment, fiduciary relationship, or joint venture.
6) Representations, warranties, and disclaimers
6.1 Property Owner representations
You represent you have authority to enter and comply with this Agreement and that your listing content does not violate law or third-party rights.
6.2 Disclaimers
To the fullest extent permitted by applicable law, the Platform and Services are provided “as is” and “as available” without warranties or conditions of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.
Nothing in this Agreement excludes warranties that cannot be excluded under applicable law.
7) Indemnification
You will indemnify and hold harmless FFC and our affiliates/service providers (and their directors, officers, employees, and agents) from claims and losses arising from your Property, your listing content, your rental activity, your breach of this Agreement, or your negligence/willful misconduct.
8) Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, consequential, special, aggravated, exemplary, or punitive damages. Our aggregate liability under this Agreement will not exceed the fees you paid in the 12 months before the event giving rise to the claim, except where prohibited by law.
9) Term and termination
The Agreement continues for the term in the Listing Agreement unless terminated earlier. We may suspend or terminate access for breach, misuse, fraud risk, or integrity/safety concerns. Refunds are not provided upon termination for breach except where required by law.
10) Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil disorder, labour disruptions, third-party infrastructure failures, or government actions, where performance cannot reasonably be avoided.
11) Assignment
You may not assign this Agreement without our prior written consent. We may assign this Agreement in connection with a reorganization, financing, merger, acquisition, or sale of assets.
12) Governing law and dispute resolution
This Agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Unless a different venue is required by applicable law, proceedings relating to this Agreement will be brought in the courts located in Vancouver, British Columbia.
13) Miscellaneous
- Notices: notices must be in writing and delivered using the methods permitted in the Listing Agreement; contact details are those on file.
- Severability: if a provision is unenforceable, the remainder remains effective.
- No waiver: failure to enforce a provision is not a waiver.
- No third-party beneficiaries: the Agreement benefits only the parties and permitted successors/assigns.
- Headings: headings are for convenience only.
- Entire agreement: these Listing Terms + Platform Terms of Use + Listing Agreement form the entire agreement on listing services.
